Introduction

We are committed to protecting the privacy of client information and to handling your personal information in a responsible manner in accordance with the Privacy Act 1988 (Cth), the Privacy Amendment (Enhancing Privacy Protection) Act 2012, the Australian Privacy Principles and relevant State and Territory privacy legislation (referred to as privacy legislation). 

As used throughout this policy, the term “Bodyspace Studios” refers to Bodyspace Studios PTY LTD, ABN 38 639 520 004.

This Privacy Policy explains how we collect, use, and disclose your personal information, how you may access that information and how you may seek the correction of any information. It also explains how you may make a complaint about a breach of privacy legislation.

This Privacy Policy is current from the 10/11/2020 and is reviewed periodically.

We may amend or update our Privacy Policy, processes, and systems in relation to how we handle your personal information at any time and will publish any updated policy on the Bodyspace Studios website. We encourage you to check the Bodyspace Studios website regularly to ensure that you are aware of the terms of our current Privacy Policy.

By visiting Bodyspace Studios and submitting any personal information to us (whether in a studio, via our website or otherwise), you are accepting and consenting to the practices described in this Privacy Policy.

This policy describes the types of personal information that we may collect about you, the purposes for which we use the information, the circumstances in which we may share the information and the steps that we take to safeguard the information to protect your privacy.

Collection & USe

We collect information that is necessary and relevant to help us continually improve your experience with Bodyspace Studios and to provide you with a safe space within our studio. Additionally, personal information is used to provide services you request from Bodyspace Studios such as to facilitate: Administration of your membership of the studio, to manage our relationship with you, to communicate with you, to assist you with queries and to facilitate bookings of classes and/or appointments with our own or third party service providers and other transactions.

This information may include your name, contact information, preferred communication methods, address, date of birth, gender, health information, family history, credit card and direct debit details and your objectives and interests. This information may be stored on our computer system and/or in handwritten records.

We collect information in various ways, such as over the phone, or in writing, in person in our studio or over the internet if you transact with us online. This information may be collected by studio staff and Directors.

In emergency situations we may also need to collect information from your relatives or friends.

Also, Bodyspace Studios will create information that becomes part of the personal information we hold about you, such as your membership number and your usage of the club and the products that you purchase from us. We may also collect and create details on joint members and other family members, where applicable, including family members under the age of 18.

 We may also collect the following information:

  • Sensitive information: The term “sensitive information” in this context refers to information related to your racial or ethnic origin, political opinions, membership of a political association, religious beliefs or affiliations, philosophical beliefs, membership of a professional or trade association, membership of a trade union, sexual orientation or practices or criminal record, or your health information, genetic information that is otherwise not health information, or biometric information or templates. Whilst we do not generally collect sensitive information unless it is volunteered by you, we do specifically collect health data to the extent that it is required to assess your readiness for physical exercise.

  • Personal Information from Children: Other than information that becomes part of the personal information we hold about our under 18 members such as their membership number and usage of the club and the products that are purchased on behalf of under 18 members, we do not knowingly collect personal information from individuals under 18 years of age without the permission of their parent or guardian. As a parent or legal guardian, please do not allow your children to submit personal information without your permission.

  • Photographs for Membership Cards: In the interests of security and the prevention of crime, we take a digital photograph of each member to whom sign up to membership. This is including our under 18-year-old members. By providing the digital photograph to us, you are consenting to our using it in the manner set out in this Privacy Policy.

  • Photos & Social Media: Our studio staff and students are encouraged to take videos and photos, of themselves only, to encourage self-confidence, growth, and reference to their achievements. Bodyspace Studios may also take photos and/or videos for promotional use, as a learning resource, or other relevant requirements. If you do not wish to be in any photo or social media, please advise the instructor in your class. If you witness another student taking photos/videos and suspect that you may be captured in that media and that you do not wish to be, please consult with your instructor.

 We may also collect and use personal information you provide when interacting with us via social media, when you enter competitions, when you participate in promotions or events, or hold an event in our studio. This information may be collected by us directly, or by a third party on our behalf, and may include your photos, comments, and experiences you provide or share with us.

If you provide personal information to us via third parties or social media platforms, your personal information will be managed in accordance with the privacy policy in use by that third party, in addition to our own Privacy Policy.

If you share your contact information with us via Facebook, Instagram or any other social platform in response to a promotion by us, we may contact you to market our products unless you opt out of marketing communications.

 If you contact us, we may keep a record of that correspondence and if you have enquired about our products we may contact you to market our products unless you opt out of marketing communications (opt out via our marketing channels or by sending an email to hello@bodyspacestudios.com).

  • Surveillance: CCTV may be present in and outside our studio for health and security reasons. If you have any queries in relation to the use of CCTV operating in and around our studio, please contact us (hello@bodyspacestudios.com).

You are entitled to request access to your personal records. We request that you put your request in writing and we will respond to it within a reasonable time. 

There may be a fee for the administrative costs of retrieving and providing you with copies of your records. 

Data Quality and Security 

How secure is your information? Bodyspace Studios will take reasonable steps to ensure that your personal information is accurate, complete, up to date and relevant. We endeavour to take all steps as are reasonable in the circumstances to protect your personal information from misuse, interference, and loss and from unauthorised access, modification, or disclosure.

For this purpose, our staff may ask you to confirm that your contact details are correct when you attend a class (or the studio). We request that you let us know if any of the information we hold about you is incorrect or out of date. 

Personal information that we hold is protected by:

  • securing our premises

  • placing passwords and varying access levels on databases to limit access and protect electronic information from unauthorised interference, access, modification, and disclosure; and 

  • providing locked cabinets and rooms for the storage of physical records.

Use and Disclosure

We will treat your personal information as strictly private and confidential. We will only use or disclose it for purposes directly related to you and your use of the studio and its services, or in ways that you would reasonably expect that we may use it for your ongoing time at Bodyspace Studios. 

There are circumstances where we may be permitted or required by law to disclose your personal information to third parties. For example, to Police, insurers, solicitors, government regulatory bodies, tribunals, courts of law, hospitals, debt collection agents etc.

We may disclose information about you to outside contractors to carry out activities on our behalf such as an IT service provider, solicitor, or debt collection agent.

  • Corrections - If you believe that the information, we have about you is not accurate, complete, or up to date, we ask that you contact us in writing (hello@bodyspacestudios.com)

Access

We may deny access to your personal records in certain circumstances permitted by law, for example, if disclosure may cause a serious threat to your health or safety. We will always tell you why access is denied and the options you must respond to our decision. 

  • Complaints: If you have a complaint about the privacy of your personal information, we request that you contact us in writing. Upon receipt of a complaint we will consider the details and attempt to resolve it in accordance with our complaints handling procedures. If you are dissatisfied with our handling of a complaint or the outcome you may make an application to the Australian Information Commissioner or the Privacy Commissioner in your State or Territory. 

  • Overseas Transfer of Data: We will not transfer your personal information to an overseas recipient unless we have your consent, or we are required to do so by law.
