MEMBERSHIP TERMS & CONDITIONS

I am aware that if I am on a subscription membership, I will be automatically debited according to my billing cycle. BSS does not offer refunds or extension of credits. Changes to subscriptions need to be emailed 3 business days prior to billing.

Covid-19 Safety Clause: By agreeing to these Terms & Conditions, I acknowledge that we are coming out of a COVID-19 pandemic and that I choose to visit BodySpace Studios, attend its classes and partake in its activities with this knowledge.

I hereby waive BodySpace Studios, its officers and employees from any liability of sickness or illness due to contracting COVID-19, or any other pandemic related illness or injury.

I also acknowledge that I am following and abiding by the Government's advice, rules and regulations in relation to COVID-19, including but not limited to my vaccination requirements.

By proceeding with these Terms & Conditions, I understand the contents of this clause, am aware that it is legally binding and that am signing it of my own free will.

Things to know at the start of your membership

1.1 When can you book into your classes? As soon as you have purchased a membership plan or a casual session pack. We have a 4 week scheduling window so you can book into your classes 4 weeks ahead for the duration of your membership or until all your class credits have been used up.

1.2 Understand your membership commitment: As a member, you can use our studio in line with these terms and conditions, including our studio code.

1.3 How old do you have to be? You must be at least 18 years old to become a member. If you are under 18, a parent or guardian must sign your membership agreement and pre-exercise questionnaire. You can then take part in group fitness classes that do not include Pole Choreo. You may not do unsupervised practice time. If you are 16 or 17, a parent or guardian must co-sign your agreement and pre-exercise questionnaire. You may then access all our class options, including practice time.

1.4 What about your health? On the day you sign your agreement and each time you use our studio, you promise us that you are in good physical condition, you know of no medical or other reason why you cannot or should not do active or passive exercise. Our staff and contractors are not medically trained. They are not qualified to assess if you are in good physical condition and can exercise without risking your health, safety or comfort. If you have any doubts, we strongly urge you to seek expert advice before starting an exercise program.

Things to know during your membership

2.1 Can I cancel a class? You can cancel your class 12 hours prior to class time and you will receive your class credit back. If you cancel a class within the 12 hour cancellation window, you can still manually remove yourself from the class however that class credit will be lost.

If you are sick or injured, a doctor’s certificate will be required if you need to cancel your class within the 12 hour window. This will allow the studio to honour that credit back to your account. This credit will be valid as per your membership cycle. No credit will be returned for a no show. Class must be cancelled prior to class commencement for Bodyspace Studios to honour the class credit back.

Extensions for credits that are not able to be used within the existing membership cycle will be transferred onto the next membership cycle. So long as the member holds the same active membership on their account.

2.2 What happens if I forget to cancel my class? If you do not show up to a class, you will be marked off as a no-show, lose that class credit and will be given a strike. If you exceed 3 strikes, you will be restricted from booking any more classes and you will need to contact hello@bodyspacestudios.com to unlock your account.

2.3 How do direct debits work? We will debit your membership fees from your nominated account from the day you purchase your membership. Your responsibilities include making sure:

  • Your account can accept direct debits (your financial institution can confirm this)

  • There is enough money in your account on the payment day

  • You tell us if you are transferring or closing your account, at least 3 business before your next direct debit

  • You tell us about any changes to your credit card, such as its expiry date or number, at least 3 business before your next direct debit

2.4 What happens if your payment is late or fails? If you do not fully pay your fees on the due date, we will suspend your studio access until your payments are up to date and you have given us your account details. We will also charge you a late payment fee of $7.50 for a failed payment. This will be debited from your account, and you authorise us to do this.

We will continue to debit your nominated account without notice, until we have received the total amount you owe us. We will make a reasonable effort to let you know beforehand by phoning you or speaking to you at the studio, and writing to the address you last gave us.

For membership/s in your name, you must make sure that the payment method you choose continues for the length of your agreement. This includes third-party accounts. If the details you give us fail, you are liable for all resulting fees.

If you default in payment of your membership fees we may send your outstanding debt to a third party debt collection agency to collect your outstanding fees. If this debt is sent to a third party further fees and charges may be payable.

2.5 Can we change your agreement? We may sometimes add to, change or remove our terms and conditions. This includes changing a studio's opening and closing hours, its services and facilities and membership fees. You can find copies of our terms at the studio or on our website at www.bodyspacestudios.com . We will give you at least 14 days' notice of any changes, for instance by publishing them in our newsletter or on our website, placing a notice in the studio, phoning you or writing to the address (post or email) you last gave us. If we suspend a studio's operations or services, temporarily or permanently, we may send you a written notice offering you either a credit/transfer, if available a complimentary time freeze. If we do not fulfil our obligations to you, you may be able to cancel your membership. Unless the law states otherwise, you won’t have any other claim against us if this happens.

2.6 Can we increase your fees? Your membership fees will only increase if we provide you with at least 14 days beforehand by writing to the email address you last gave us. We will consider you to have received our email on the second business day after it is sent.

2.7 Can you stop/cancel your membership? Our recurring payment packages are recurring and billed according to your membership type. This means they are auto-renewing so you get access until you decide to hit pause.

Recurring Memberships -You can stop your recurring membership payments. You just need to email us (hello@bodyspacestudios.com) up to 3 business days before your next billing cycle.

We don’t pause memberships mid-cycle, however an extension into members next membership cycle will be given upon request between the Christmas and New Year period each year. So long as the member holds the same active membership on their account.

If you’re on a casual session pack, no refunds will be given and your package will end within the expiry window of 3 months from the date of purchase.

IMPORTANT - Choose your membership wisely. Should you wish to cancel a debit, please ensure you do so by letting us know via email up to 3 business days prior to your next billing cycle.

Please note no refunds will be given and debits are unable to be adjusted/paused or cancelled within 3 days of its debit date.

2.8 Can I use the lockers? Yes you can! Locker rules are as follows:

- First in first served

- One locker per student

- $15 fee for loss of key

Locker key must be returned to reception after last class or before physically leaving the studio

Note: BodySpace Studios does not hold any responsibility for any theft, loss or damage of your belongings

2.9 Can I hire a shower towel? Yes, absolutely! For all our members, you may hire a towel from reception for $3. Towels must be returned to reception to avoid a non-return fee of $35.

3.0 How can you protect your health? If you believe any studio activities might risk your health, you must tell us this in writing with full details. You must also tell us if your medical condition changes after you join. We may choose to refuse your membership agreement until your doctor agrees in writing that you are fit to exercise, you show us proof that you have received medical advice on an appropriate exercise program. You must not use club facilities if you have an infection, contagious illness or physical ailment, such as an open cut or sore, and if there is any other risk, however small, to other members and guests.

Things to know at the end of your membership

3.1 Transferring your membership to another person: You cannot transfer your membership to another person.

3.2 Can you cancel if we change the agreement? We reserve the right to change or add to these membership terms and conditions or the studio code. If by making such changes you are adversely affected you may terminate this agreement. For the avoidance of doubt however, changes to studio timetables, facilities and hours of operation does not constitute a change of this membership agreement for the purposes of this clause.

You can also cancel your membership if we breach our obligations and we do not fix the breach in a reasonable time after you have told us about it in writing. We will refund you any membership fees you pay between the date of notification and the date on which we decide that we cannot fix the breach. In either case, you need to give us 14 days notice. We do not charge an exit fee. If you pay for a program in advance, we will refund the fee within 6 months of purchase if the program is cancelled, you can show us medical evidence that the program will cause you physical harm or injury. We will not refund you if the prepaid program has already expired.

Legal things you must know about

4.1 What are your responsibilities? Your responsibilities, including payment of membership fees, do not depend on how often you use the studio. You must tell us about anything that affects your membership, and any changes to your contact and bank details.

You promise to make sure that you know how to exercise safely, by asking if necessary. Use your best endeavours to exercise safely and not take valuables into the studio, even if you plan to put them in a locker.

4.2 Do we have a privacy policy? During your membership, we will have access to personal information about you, such as about your health and financial situation. We will only use, disclose or deal with your information in line with our privacy policy. This Privacy Policy applies to the services offered by Bodyspace Studios Pty Ltd (ABN 38 639 520 004) (Bodyspace Studios).

Bodyspace Studios is committed to protecting your privacy and any personal information we collect. Bodyspace Studios complies with the Privacy Act 1988 (Cth). This policy explains how we may collect, use, disclose and otherwise handle personal and sensitive information. Bodyspace Studios is committed to safeguarding personal privacy. It recognises that individuals have a right to control how their personal information is collected and used. Providing personal information is an act of trust and it is taken seriously. Unless given consent to do otherwise, Bodyspace Studios will only collect and use personal information as set out below. For the purposes of this Privacy Policy personal information may mean some or all of the following: A member’s name, contact details, date of birth, emergency contact details, bank account and/or credit card details, student identification details, employment details, payment history and sensitive information.

4.3 Bodyspace Studios and links to other websites: Bodyspace Studios provides links to websites outside of the Bodyspace Studios site. These linked sites are not under the control of Bodyspace Studios, and Bodyspace Studios is not responsible for the conduct of companies linked to the Bodyspace Studios website, nor for the performance or otherwise of any content and/or software contained in such external websites.

4.4 Problems, queries or complaints: For further information regarding this Privacy Policy or to make a complaint about the steps taken by Bodyspace Studios to protect your personal information or privacy, please contact us at hello@bodyspacestudios.com. We will investigate any complaints received in writing and do our best to resolve them as soon as possible.
